Holder and general terms and conditions of contract

These General Terms and Conditions of Contract (hereinafter, GTC) regulate the conditions of purchase of the different products and services offered on the website owned by EAGLE GOLF MANAGEMENT, S.L. with CIF B-65738577 & MONSIERRA GESTIÓN S.L. with NIF CB65-136690, (hereinafter, CLUB GOLF D’ARO – MAS NOU),and registered office at Tavern, 3, 08021, Barcelona (Spain).

Users who make purchases of products and/or services fully accept these GTC and are bound by them as they were drafted at the time of contracting. It will be an essential requirement to read and accept the GTC prior to the purchase of any product.

CLUB GOLF D’ARO – MAS NOU reserves the right to modify the GTC, at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.

Only those over 18 years of age with sufficient capacity to contract may purchase products on our website.

Reserves

The process of purchasing and placing your order can be done in very simple steps. It is not necessary to be registered and/or authenticated on the website in order to make your reservations. However, if you register, you will have the ability to view details of orders you have placed on our site while authenticated, as well as request to cancel or modify them.

The user-customer who makes the reservations and pays the total amount of the order does so in the name and with the consent of all the people for whom the reservation is completed, the user-customer who makes the purchase must be of legal age and the holder of the credit card with which the purchase is made.

Before paying for your order you must confirm the details of all the bookings included in it. If you do not agree, you have the possibility to modify your data, as well as add and/or delete reservations in it. Once you have confirmed your booking details and successfully executed the payment for your order, you will be subject to the GTC.

Products

The items offered through the Club Golf d’Aro website are only available for collection in store.

By placing an order through this website, you represent that you are over 18 years of age and have the legal capacity to enter into contracts.

Once the purchase is made, you will receive a confirmation of the transaction via email.

Unless there are circumstances arising from the personalisation of the products, or unforeseen or extraordinary circumstances arise, you may collect the product within 2 hours, always within the opening hours of the premises, by presenting the purchase confirmation.

All orders are subject to product availability. If there are difficulties in the supply of products or if there are no items left in stock, we will refund the amount you may have paid.

Prices

All prices indicated on the website are inclusive of VAT. However, you’ll see the price and VAT breakdown before finalizing the order.

CLUB GOLF D’ARO – MAS NOU reserves the right to modify prices at any time, always respecting the price indicated at the time of purchase.

Payment methods

Payment by credit card

The customer can choose to pay by credit card, and the operation is carried out at the time of placing the order.

At CLUB GOLF D’ARO – MAS NOU we use the system called SSL (Secure Sockets Layer), a payment system in a secure environment as it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

As a fraud protection measure, you may request customers to send additional documentation via email to certify the identity of the buyer as the lawful owner of the credit card. This accreditation may be attached digitally in .pdf or .jpg format in the same email in which it is requested, to speed up the procedures for validating the order and proceed with its shipment as soon as possible.

Returns

RESERVAS GREEN FEES

• Modifications will not receive any penalty.
• Cancellations made more than 48 hours in advance will not receive any penalty, and 100% of the amount of the reservation paid will be refunded.
• Cancellations made less than 48 hours in advance will be penalized with 50% of the total amount of the reservation.
• Cancellations made on the same day as the reservation of your tee time or “no show” will be penalized with 100% of the total amount of the reservation.
• Bookings of more than 4 people, will apply instead of 48h a limit of 7 days will apply for cancellation without charges.

TOURNAMENT REGISTRATION

• Cancellations made less than 24 hours in advance will be penalized with 50% of the total amount of the reservation or you have the possibility of changing your registration to another tournament of the same amount.
• Cancellations made on the same day of the tournament or “no show” will be penalized with 100% of the total amount of the registration.

No refunds will be accepted in the following cases:

• The period established for this purpose has elapsed

The refund will be made in the chosen payment method.

Closed field

The main causes that could lead to the closure of the facilities of Club Golf d’Aro – Mas Nou are the following:

• Incessant rain: when the holes fill with water.
• Thunderstorm: when continuous lightning or thunder appears with imminent danger.
• Intense fog: preventing minimum visibility for golf.

The following conditions shall apply only when the course management decides to close the course either because of danger to the player or because of impracticable playing conditions:

• If you have not yet gone out to play you will be offered to change your Tee Times.
• If they have abandoned play between holes 1 and 9, they will be given a discount for 9 holes with a maximum validity period of 3 months.
• If they have abandoned the game after the 14th hole, the game will be understood as finished.

Protection of personal data

In accordance with the provisions of the regulations on the protection of personal data, we inform you that the data you voluntarily provide us with when making any purchase will become part of a file owned by CLUB GOLF D’ARO – MAS NOU, in order to manage your reservation, post-reservation service and customer service. In addition, we will periodically send you information about offers for our products.

The basis of data processing is the performance of a contract. The data will be kept at least in accordance with the provisions of tax and commercial regulations and in any case as long as you do not request its deletion.

You may exercise your rights of access, rectification, deletion, opposition, portability and limitation, as well as, where appropriate, revoke your consent, by email to specifying “DATA PROTECTION” in the subject line or by ordinary mail to Tavern, 3, 08021, Barcelona (Barcelona). We inform you of your right to lodge a complaint with the Data Protection Supervisory Authorities.

We would appreciate it if you could keep your personal data up to date, so that CLUB GOLF D’ARO – MAS NOU can comply with its obligation to keep them accurate and updated.

The user undertakes to provide truthful data relating to him/herself, assuming any type of responsibility regarding the inaccuracy of the data and/or manipulation of data relating to third parties, since CLUB GOLF D’ARO – MAS NOU will presume that the data have been provided by the owner of the same and that they are accurate and truthful.

Jurisdiction

These GTC are governed by Spanish law.

In order to resolve any controversy or conflict arising from the purchase of products at CLUB GOLF D’ARO – MAS NOU, the parties agree to submit to the courts or tribunals of BARCELONA, both parties waiving any jurisdiction or jurisdiction to which they may be entitled, except for mandatory jurisdiction in the case of consumers and users, in which case the competent jurisdiction will be that corresponding to their domicile.
